To show the seller you are really interested in buying his property you’ll be asked to undersign a Purchasing Proposal and leave a deposit that depends on the price of the house you want to buy.
THE PURCHASE PROPOSAL is a legal contract in which the client/PURCHASER promise to buy the property he likes. The deposit will show the seller you are really interested so it will not been shown to others.
After you have paid the deposit, the necessary papers will be taken to the notary so he will start the searches and seeing if there are any debts against the land. If you pull out for no reason some of the money pays for this. If you do pull out this deposit is not refundable. If there’s an unresolvable problem with the papers or the seller pulls out you will get this back in its entirety.
Waiting for all papers to be ready, you can undersign the COMPROMESSO or Preliminary CONTRACT by paying a further amount of the agreed price. It’s a legal contract. When the seller decides not to sell anymore, he should give you back twice the amount you paid. The same is true if a buyer decides not to buy. You can choose to undersign the compromesso or straight through to the final contract (rogito).
The COMPROMESSO or Preliminary CONTRACT shows:
• The agreed sale price
• The amount to be paid as deposit (caparra)
• The completion date of the sale in front of the Notary (rogito)
• Land boundaries and details of the property

When the final contract (rogito) is ready, the Vendor and the Purchaser (or their nominated representatives) need to be present for the signing. The balance of the purchase price is given to the Vendor. Any other payments and the notary’s fees are also made.
